Geographical Indications (GI) in Intellectual Property Law
Geographical Indication (GI) is a relatively new area of Intellectual Property Law in India. A Geographical Indication refers to a designation that identifies a product as originating from a specific location—whether a country, region, or locality—where its quality, reputation, or distinctiveness is primarily derived from its geographical origin.
Under Articles 1(2) and 10 of the Paris Convention for the Protection of Industrial Property, Geographical Indications are recognized as an integral component of Intellectual Property Rights (IPRs). Additionally, Articles 22 to 24 of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement provide an international framework for the protection and enforcement of GIs.
As a member of the World Trade Organization (WTO), India enacted the Geographical Indications of Goods (Registration & Protection) Act, 1999 to regulate GI registrations and prevent infringement. This law ensures that goods associated with a specific region are legally protected, safeguarding their authenticity and market value.
