Government and Public ServiceThe education sector in India has witnessed considerable growth in recent times. It has been metaphorized from a charitable activity into an industry. The right to education has now become a fundamental right under Article 21A of the Constitution of India. Furthermore, the RTE Act, which came into force in the year 2011, seeks to provide free and compulsory elementary education to all children and thereby, give effect to this fundamental right. This right has also been recognized under various international covenants. The education sector is regulated by both center and state government for its falls under the Concurrent List of Schedule VII of the Constitution of India. The Ministry of Human Resource Development (“MHRD”) is the nodal ministry for education at the center. Several initiatives are being taken by the government to encourage investments in the education sector including greater participation by foreign educational institutions and educational service providers.

The Public-Private Partnership (PPP) model has also been introduced in this sector to facilitate greater Foreign Direct Investments (FDI). The education industry is thus attracting sizeable investment, especially in primary, secondary, and higher education. In India, this sector India comprises preschool, primary, and higher secondary education. This is then followed by the higher education segment, which includes professional and technical education. It also comprises vocational training, coaching classes, distance education through e-learning platforms, etc. All these segments with different regulatory bodies face various challenges like statutory compliance-related issues, reputation damage, legalities involved in setting up a school, etc.
