Role of Pollution Control Board under the Maharashtra Regional And Town Planning Act, 1966 (Special Township Act)

The Pollution Control Board finds its place in the Regulations for Special Township Project-

Mumbai Metropolitan Regional Plan

For this Regional Plan, the Regulations given in Schedule-A which have been added to the Development Control Rules by a modification dated 10th March, 2006) lays down the following role of the Pollution Control Board:

Firstly, the general requirements of infrastructure facilities relating to Drainage and Garbage disposal require the developer to make ‘environment friendly arrangements for the disposal and treatment of sewage and solid waste as per requirements of Maharashtra Pollution Control Board’. The development of this eco-friendly system is to be carried out by adopting the recycling and bio-degradation system in consultation with Maharashtra Pollution Control Board. The role of the Board that can be inferred would, therefore, be to provide all the required assistance and insight into the preparation of such a system so that the environmental concerns and apprehended impacts can be addressed.

Secondly, the final completion certificate for the scheme is to be issued by the Collector in consultation with the Maharashtra Pollution Control Board and other concerned authorities. The role of the Pollution Control Board should therefore be to ensure that the scheme is carefully examined with regard to the environmental impacts that may occur and whether proper measures have been taken to avoid any such adverse impacts on the environment by way of arrangement of proper systems and appropriate installations required to execute the same.

Pune Regional Plan

The Regulation for Development of Townships in Area under Pune Regional Plan provides for the same role to be played by the Maharashtra Pollution Control Board as in the Mumbai Metropolitan Regional Plan.

Further, the Draft Regulation For Development Of Integrated Township Project (ITP) in Annexure-B, the Accompaniment to the Government in Urban Development Department Notice bearing No. TPS-1816/CR-368/15/20(3)/UD-13, dated 07/06/2016 provides for arrangements for the disposal and treatment of sewage and solid waste generated in the project at source, as per the norms of the Maharashtra Pollution Control Board which further adds to the role of the Board to issue comprehensive norms for the purpose.
